These Terms of Use (the “Terms”) govern your access to and use of the websites, mobile applications, and digital banking services made available by OBS Bank (“OBS Bank,” “we,” “us,” or “our”), a member of OBS Financial Group. By accessing or using our services you agree to be bound by these Terms and by any product-specific agreements that apply to the accounts and services you use.

To use OBS Bank services you must be of legal age to enter into a binding contract in your jurisdiction, be legally permitted to receive our services under applicable law, and not be listed on any government sanctions or restricted-persons list. We may refuse, restrict, or terminate access at our discretion where eligibility is not met.

You agree to provide accurate, current, and complete information when you register for an OBS Bank account, and to keep that information up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly if you suspect any unauthorized access.

You are responsible for reviewing your account statements and transaction history, for the accuracy of instructions you submit, for maintaining current contact details, and for complying with the terms of any product or service you use. You agree not to use OBS Bank services on behalf of any other person unless you have express written authority to do so.

You authorize OBS Bank to verify your identity and to obtain and use information from identity verification providers, credit reference agencies, sanctions screening services, and public records to satisfy our Know Your Customer, Customer Identification Program, and anti-money-laundering obligations. We may request additional information or documentation at any time.

You agree not to use OBS Bank services in any manner that violates applicable law, infringes the rights of others, or interferes with the operation or security of our services. Prohibited activities include unauthorized access attempts, transmission of malicious code, scraping, reverse engineering, and use of our services for money laundering, fraud, or the financing of illegal activity.

You consent to receive communications from OBS Bank in electronic form, including account notices, disclosures, statements, tax documents, and legal notices. Electronic communications have the same legal effect as if they were provided in paper form. You may withdraw this consent by contacting us, subject to any impact on your ability to continue using certain services.

You must safeguard your credentials, enable available authentication factors, use supported devices and current software, and report suspected compromise immediately. OBS Bank will never ask for your password, one-time passcode, or full card number by email, text message, or phone call.

All content, software, trademarks, service marks, logos, and other intellectual property associated with OBS Bank services are owned by OBS Financial Group or its licensors and are protected by law. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the services for their intended purpose. No other rights are granted.

We work to keep our services available at all times but do not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable due to maintenance, upgrades, security events, or circumstances beyond our control. We may add, modify, suspend, or discontinue features at any time.

To the maximum extent permitted by law, OBS Bank and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or relating to your use of the services. Nothing in these Terms limits liability that cannot be excluded under applicable law.

We may suspend or terminate your access to the services, close or restrict accounts, or refuse to process transactions where we reasonably believe it is necessary to comply with law, manage risk, prevent fraud, or protect you, other customers, or OBS Bank. You may close your OBS Bank account at any time in accordance with the applicable product terms.

These Terms are governed by the laws of the State of New York and applicable federal laws of the United States, without regard to conflict of law principles. Additional or different laws may apply to specific products or to customers in specific jurisdictions.

We may update these Terms from time to time. When we make material changes we will provide reasonable notice, for example by posting the updated Terms on our website or notifying you through your account. Your continued use of the services after the effective date constitutes acceptance of the updated Terms.
